AIS Referral Program Terms and Conditions

Please read the following AIS Referral Program Terms and Conditions ("Program Terms") carefully before participating in the AIS Referral Program ("Referral Program”, or “Program"). Participation in the Program constitutes your acceptance of all Program Terms.

AIS is pleased that you are participating in the Referral Program. Your participation in the Program is strictly subject to the Program Terms. About AIS

Glossary

  • Referring Party: An individual and previous or current AIS Customer who directly refers a Client to AIS.
  • Client: A person that is eligible to receive a quote through AIS for an insurance product.
  • Customer: A Client that has an active insurance policy purchased through AIS.
  • File: The Client or Customer information AIS has on record.
  • Referral or Referred Party: A Client that is referred to AIS.
  • Qualified Referral: A Qualified Referral (a) is a Client that previous to being referred has not received a quote from AIS, (b) receives a quote from AIS on an insurance policy, and (c) provides the contact information on file for the Referring Party.
  • Quote: An estimated price of the premium received from an AIS agent for an insurance policy.
  • Referral Reward: The amount AIS will pay the Referring Party for a Qualified Referral.

Referral Program Summary

Customers who refer AIS to others (clients) may qualify for the AIS Referral Program reward. AIS will issue a reward of a specific dollar amount (e.g. $25, $50, $100) to the Referring Party for each Qualified Referral. The Reward amount will be noted on the Referral Program web page, and/or in promotional materials made available to customers. Referring Party may earn up to a calendar year limit of $500 per year and a lifetime limit of $1,000. As of January 1, 2022, the lifetime limit will include previous past rewards received by the Referring Party. For example, if a Referring Party received $750 in Referral Rewards, they will be eligible to earn up to $250. To qualify for the Program's reward, Referred Party must call AIS, receive a quote for an insurance policy, and mention the Referring Party.

Participant Acceptance

AIS will make all determinations regarding participation in the Program. Current AIS and Mercury employees are not eligible to participate in this program. AIS reserves the right to terminate your participation in the Program or cancel the entire Program at any time for any reason or no reason, to the extent permitted by law. In the case of a termination, the status of pending Referral Rewards will be communicated to you. Any written notices required or permitted to be given by AIS hereunder may be delivered by email to the email address we have on file for you. By participating in the Program, you consent to the delivery of all Program-related notices and information by email to the email address you have provided to AIS, and acknowledge that you have the necessary equipment (hardware and software) to receive and read such emails.

If a Referral contacts AIS to inquire about AIS's products and services, the Referral must mention being referred and provide the name and phone number of the Referring Party during the initial call with AIS in order for the Referral Reward to be honored. Referrals will not be allocated to the Referring Party retroactively, meaning after a quote has been given without mention of the Referring Party.

Reward Processing (Payments)

Referral Rewards will typically be processed and sent out to the Referring Party within 14 days of a Referral’s quote.
AIS is not responsible for (I) Referred Party not completing a quote, (II) Referred Party not mentioning being a Referral or not proving essential information for whom referred them, (III) delays or failure to send rewards due to outdated customer email address, or (IV) Referring Party deleting or losing a reward after it has been sent.

CAN-SPAM Act Compliance

AIS complies with the federal CAN-SPAM Act and honors requests of clients and customers who choose to opt-out of receiving AIS marketing emails. Accordingly, if the Referring Party has previously unsubscribed from receiving AIS marketing emails, they will not be able to receive Referral Program correspondence.

Independent Contractor Relationship

Your participation in the Program does not authorize you to act on AIS’s behalf. Nothing herein is intended or will be construed to constitute or imply a joint venture, employer-employee relationship, partnership or association between you and AIS. By participating in the Referral Program, you acknowledge that you do so at your own risk and as an independent contractor and that AIS is not directing how you perform your obligations hereunder. You are solely responsible for making any disclosures required by law, including disclosing the possibility that you may receive a Referral Reward. You will not make guarantees of savings as a result of conducting business with AIS, solicit door-to-door either to residents or businesses or represent yourself as a representative of AIS. You are solely responsible for the information you share about AIS and claims you make concerning AIS.

Trademarks

Your status as a participant in the Referral Program does not entitle you to use any trademarks, copyrighted materials, patents, names, logos or other intellectual property owned or licensed by AIS.

You are not allowed to use, register, or attempt to use or register AIS or any of AIS’s trademarks, product names, service names, service marks, or any derived of the foregoing, for any Internet domain name, email address, social media handles, or online aliases. Additionally, you cannot use or register domain names, email addresses, social media handles, and/or online aliases that could cause confusion, or be misleading or deceptive, in that they cause individuals to believe or assume the communication is from or is the property of AIS.

Indemnification

By participating in the Program, you agree to and will indemnify and hold AIS, its shareholders, directors, officers and employees harmless from and against any and all damages, costs, expenses, claims or liabilities of any kind, including third-party claims, whether pending or threatened, including without limitation, attorneys' fees and court costs, incurred by any of them arising out of or related to your participation in the Program or breach of these Program Terms and any applicable laws.

Warranty Disclaimers; Limitation of Liability

You expressly agree that your participation in the Program is at your own risk. The Program is made available to you on an "as is" basis without warranty of any kind, express or implied. Neither AIS, its shareholders, officers, directors or employees, through these Program Terms, makes any warranty regarding the Program, and each expressly disclaims all warranties, express or implied, including without limitation warranties of merchantability or fitness for a particular purpose. In no event shall AIS, its shareholders, officers, directors or employees be liable for special, indirect, consequential or incidental damages or damages for loss of profits, revenue, use, or data as a result of claims, whether brought in contract or tort, arising out of or connected with these Program Terms or the Program, even if AIS has been advised of the possibility of such damages.
